Intellectual Property and Trade Marks

| Print |

Our Intellectual Property and Trade Marks practice provides boutique expertise and service with the backup of a full service law firm. We are experienced in the full spectrum of intellectual property and brand protection issues.

Intellectual property law is complex and evolving, particularly with the continual emergence of new technologies and business models. Copyright materials, patents, trade marks, know-how, confidential information and trade secrets are core to the commercial viability and competitive advantage of most organisations. Clients seek our expertise because we can be relied upon to identify, secure and protect their valuable intangible assets.

We conduct intellectual property audits and provide strategic advice on IP asset management and commercialisation. We advise extensively on commercial transactions, including licensing, assignment, research and development, feasibility, evaluation, clinical trial and technology transfer agreements.

Increasingly, creating and leveraging a brand is a business imperative. We assist with brand protection and advertising, covering advertising clearance, domain names and trade marks searching and registration services, and “white-labelling” of manufactured products. We also advise on sponsorship agreements in traditional and "new" media. We act for both creators and acquirers of content in the print, electronic and digital media.

Whether you are a new entrant setting up your business channels, or an established business entering into a new technology alliance, our experts will help you meet your business objectives.

Our relevant experience includes acting on the following matters.

  • Global Rebranding: We have acted for an international insurance company in its re-branding. This involved strategic advice in transitioning to the new brand, establishing an IP holding company and assignment and cross licensing documentation, third party licence agreements for use of the new brand and extensive trade mark registrations to secure rebranding for the product portfolio. We also conducted seminars with senior in-house personnel about the transition to the new brand and the importance of vigilance and control of the trade marks.
  • Credit Risk Management: We have advised a leading provider of credit risk management services on the protection of the information in its databases, including an analysis of copyright that may subsist and how best to maximise its protection as a work of copyright.
  • International Advertising Agency: We provide advertising copy clearance advice to this agency on major advertising campaigns.
  • Trade Marks: we handle the trade mark portfolio of a number of recognised Australian brand owners.
