Jonathan Kramersh is as a Senior Partner in the Litigation practice and Insolvency and Forensic Services Group, based in Melbourne.

He practices in all aspects of commercial litigation, reconstruction and insolvency with particular emphasis on asset recovery, contractual, trade practice disputes and regulatory compliance.  His practice includes:

  • major corporate litigation in superior court jurisdictions
  • regulatory compliance and enforcement
  • property and lease disputes
  • acting for insolvency practitioners in all aspects of external administrations, property/asset recovery , insolvent transactions, directions and public examinations
  • representing lenders, financiers in recovery and enforcement of securities

Jonathan has extensive commercial litigation, dispute resolution and insolvency law experience and has led and managed large legal teams in the management of commercial disputes of all sizes and complexities and worked on many high profile insolvencies.

Major Transactions

  • Acted for a director of a publicly listed Super Fund to successfully challenge alleged contraventions of the SIS Act and successfully set aside a decision by APRA to disqualify the directors of the Super Fund.
  • Acted for a public company in Federal Court proceedings against interests associated with David Tweed.
  • Acted a publicly listed company in relation to the defence and dissolution of injunctions brought by a member of the company to injunct the publicly listed company from entering into significant transactions that they alleged was financial assistance in contravention of s.260A of the Corporations Act.   
  • Acted for Ansett and its Administrators in Ansett’s claim against Diners Club in the Supreme Court of Victoria.
  • Acted for a publicly listed telecommunications company in the successful defence of alleged breaches of Trade Practice Act.
  • Acted for an electricity network infrastructure owner in a successful defence of proceedings brought against it in relation to the Basslink Project.
  • Acted for the Liquidator of the Pyramid Building Society in numerous recovery proceedings including a successful challenge in the High Court of Australia on the interpretation of bankruptcy law provision
  • Acted for the Maritime Union of Australia and its members in the ‘Docks dispute’ following the placing of 4 Patrick employee companies into voluntary administration.  Supervised and led the corporations law and insolvency issues, co-ordinating and working with large client and legal teams.
